Terms and Conditions

1. Introduction

Stud-IA is a platform operated by Elevatec Techlearn S.L., with Tax Identification Number (NIF) B19935345, and registered office at Calle Bisagra 11, Galapagar, 28260, Madrid, Spain, incorporated under Spanish law. This platform is committed to providing a secure and transparent environment for its users. By registering on the platform, the user accepts these Terms and Conditions, including the payment policies, subscriptions, refunds, use of Studokens, and other financial conditions described herein.

2. Acceptance of Terms and Financial Policies

By registering with Stud-IA, the user confirms that any future transactions within the platform will be subject to the terms described herein.

Before processing any payment or subscription, a notification will be displayed reminding you that the transaction is subject to these policies.

In the event of changes to payment policies, users will be notified at least 15 days in advance.

3. General Conditions of Use

3.1. Rules of Conduct

To ensure a safe and constructive environment on Stud-IA, users must comply with the following rules of conduct:

Maintain a respectful and professional demeanor in all interactions within the platform.
Do not share offensive, defamatory, discriminatory, or illegal content.
Do not publish false or misleading information.
Respect the privacy and rights of other users.
Do not use the platform for fraudulent or deceptive activities.
Access to the Stud-IA account is personal and non-transferable. Sharing login credentials with third parties is prohibited.

Academic Honor Code

It is expressly prohibited:

Using the platform to commit academic fraud.
Share answers or resources protected by teachers or institutions.
Disseminate confidential material without authorization.

3.2. Use of Content and Intellectual Property

All content generated by Stud-IA, including academic resources obtained through Studokens, is the exclusive property of the platform.
Users are not permitted to share, distribute, sell, or reuse content generated outside of the platform.
Stud-IA reserves the right to modify, update, or delete content without prior notice if deemed necessary.

User-generated and uploaded content license

The user grants Stud-IA a worldwide, royalty-free, perpetual, sublicensable, and irrevocable license to the content they upload or generate, including files, text, prompts, or instructions, for the purposes of support, product improvement, AI model training, analytics, and security.

The user waives moral rights to such content and agrees to its anonymous use for training algorithms or developing functionalities.

3.3. Restrictions and Prohibited Uses

Attempting to breach the security of the platform or access other users' information without authorization.
Exploiting errors, bugs, or system failures for personal or third-party benefit.
Misuse Studokens, including attempting to transfer them outside the platform or trade them in an unauthorized manner.
Sharing, selling, or transferring Stud-IA accounts.
Use scripts, bots, or any other automated methods to manipulate the platform.
Post or distribute spam, malicious content, or illegal materials.
Using the platform for purposes contrary to law or to violate the intellectual property of third parties.

3.4. Consequences of Non-Compliance

Stud-IA reserves the right to take the following actions in the event of non-compliance with these rules:

Issue formal warnings.
Temporarily suspend the account.
Permanently delete the account in serious or repeated cases.

Users can submit appeals, which will be evaluated by the Stud-IA team. The final decision will be made by the platform.

4. Payment Methods

Stripe is the payment gateway used by Stud-IA.
Stud-IA accepts payment methods supported by Stripe.
In the event of a payment failure, the charge may be automatically retried before access is suspended.
Stud-IA may suspend service until payment is successfully completed.
Stud-IA may place outstanding balances into collections if they are not resolved within the stipulated time.

5. Subscriptions and Recurring Payments

Stud-IA offers monthly, quarterly, and annual subscriptions at various Studokens levels.

All subscriptions renew automatically unless canceled before the next billing cycle.

There are currently two active subscription levels:

Standard level: includes a set monthly amount of Studokens.
Unlimited Tier: Unrestricted access to resource generation with unlimited Studokens.

Users are classified as "subscribers" or "free users" depending on their payment status.

Free users cannot accumulate Studokens from one month to the next and their balance is reset each month to 50 Studokens.

By canceling a subscription, the user:

You will lose any Studokens allocated as part of your subscription from the moment of cancellation, even if there are still days of service remaining.
Your account will automatically revert to free user status if not manually deleted.

6. Cancellations

Users can cancel their subscription at any time from their account settings.
Cancellation prevents future charges, but does not generate refunds for periods already paid.
Premium access is lost upon cancellation, along with any studokens provided by the subscription.
Only Studokens acquired outside of the subscription (by direct purchase or mining) will be retained.
The account will automatically revert to free user status if not manually deleted.
Free users do not accumulate a Studokens balance and each month they start with a total of 50 Studokens available.

7. Refund Policy

No refunds are offered except:

Billing error verified.
Service malfunction that has not been resolved by technical support.
Stud-IA team criteria.

8. Studokens: Acquisition, Mining and Use

Studokens are Stud-IA's gamified virtual currency and were created to enhance the user experience within the platform. They can be obtained through:

Direct purchase with real money.
Mined by completing tasks, challenges, and achievements.
Participation in surveys within the platform and community.
Bonuses and special promotions.

Legal and operational expansion

Studokens are exclusively for use within the Stud-IA ecosystem and do not constitute a currency, cryptoasset, or regulated financial instrument.
It is prohibited to trade them outside the platform or attribute value to them outside the Stud-IA environment.
They do not expire as long as the user's account is active; however, Stud-IA may delete Studokens from accounts that are inactive for more than 12 months.
Any attempt to exploit bugs or vulnerabilities to obtain Studokens will be considered a serious violation, with the possibility of immediate account suspension at the discretion of the Stud-IA team.
Stud-IA may modify the conditions of use, obtaining, and redeeming Studokens at any time for operational, technical, or regulatory compliance reasons.

9. Taxes, Billing and Price Changes

Prices shown in the store include taxes where applicable (VAT or others).
Stripe issues payment receipts, which can be accessed in the user's profile.
Stud-IA will notify any price changes at least 15 days in advance.
Users are responsible for any taxes imposed in their local jurisdiction.

10. Dispute Resolution and General Terms

Stud-IA is governed by the laws of Spain.
Any dispute should be resolved amicably.
If this is not possible, the dispute will be submitted to individual arbitration under the exclusive jurisdiction of Spain.
The user waives the right to participate in class action lawsuits against Stud-IA.

11. International Data Processing

The user agrees that their data may be processed on servers located in Spain or the European Union.
Stud-IA does not guarantee the suitability of the service for regulated sectors such as healthcare, banking, or formal education.

12. Modifications

Stud-IA may modify these terms at any time. Users will be notified, and continued use implies acceptance.
